Terms of Service
Last updated October 27, 2026
These Terms of Service ("Terms") are an agreement between you and OpenCase LLC, a Washington limited liability company ("OpenCase", "we", "us" or "our"). They govern your use of opencase.news, opencase.app, uap.opencase.app and the OpenCase app you can install from them (together, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old to use the Services, or at least 16 if you live outside the United States and the United Kingdom. If you are under 18, a parent or legal guardian must review and agree to these Terms for you and must make any purchase.
About the Services
OpenCase is an independent news site. We publish records released by courts, government agencies and public archives, and organize them so you can search, read and investigate them in an interactive first-person interface. OpenCase is not affiliated with any court, government agency or law enforcement body, or with the archives whose records it publishes. We may add, change or retire case files and features at any time.
Content on the Services
The OpenCase name and logos, the design and software of the Services, our articles, and the way records are selected, organized and presented are owned by OpenCase or its licensors and protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for your own non-commercial purposes. You may not copy, redistribute, sell or make derivative works from them except as these Terms allow or the law permits.
Government records on the Services generally remain in the public domain. Some images and descriptions come from third parties, such as Wikipedia and Wikimedia Commons, and are used under their licenses. Names and logos of other organizations belong to their owners.
Records and accuracy
The records on the Services come from third parties and may be incomplete, mislabeled, poorly scanned or inaccurate. Appearing in a record does not mean that a person did anything wrong or illegal. We correct errors in what we add, such as summaries and labels; if you find one, tell us at support@opencase.app. Nothing on the Services is legal advice.
Your account
Some features require an account. You agree to give accurate information, to keep your password confidential, and to tell us promptly at support@opencase.app if you believe your account has been used without your permission. You are responsible for activity under your account.
Subscriptions and payments
Some content or features may require a paid subscription. Before you buy, we will show you the price, what it includes and how often you will be billed. Subscriptions renew automatically at the end of each billing period until you cancel, and you authorize us and our payment provider to charge your payment method for each renewal. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where the law requires otherwise, payments are not refundable, including for partial billing periods. We may change prices with advance notice, and a new price applies from your next billing period. Payments are processed by our payment provider, which may sell the subscription to you as the merchant of record; if it does, its terms of sale also apply.
Your conduct
You agree to use the Services lawfully and not to misuse them. We may suspend or close your account for misconduct or for breaking these Terms.
Copyright and other complaints
If you believe material on the Services infringes your copyright or violates your privacy, email support@opencase.app with the page or item, a description of the problem and how to reach you. For copyright complaints, include the information required by the Digital Millennium Copyright Act. We review every request and remove or correct material where appropriate.
Third-party content and links
The Services load some records, images and video from websites and archives run by others, and link to them. We do not control those sites and are not responsible for their content or practices; their own terms apply.
Termination
You may stop using the Services at any time and ask us to delete your account at support@opencase.app. We may suspend or end your access if you break these Terms or if we need to in order to protect the Services, other users or anyone else. Parts of these Terms that by their nature should continue after termination will continue.
Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted, secure or error-free.
Limitation of liability
To the fullest extent permitted by law, OpenCase will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or reputation, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless OpenCase from any claims, losses and expenses, including reasonable legal fees, arising from your use of the Services or your breach of these Terms.
Changes to these Terms
We may change these Terms from time to time. When we do, we will update the date at the top of this page, and for material changes we will give notice on the Services before they take effect. If you keep using the Services after a change takes effect, you accept the revised Terms.
General
These Terms and our Privacy Policy are the entire agreement between you and OpenCase about the Services. If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a term, we have not waived it. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition or sale of assets.
